§3 Certificate und CCC Marking

20) The form and content of the CCC Certificate as well as the layout and types of the CCC Mark are to be formulated by the CNCA.

21) The CCC Certificate shall at least include the following:
• Name and address of the certification consignor
• Name and address of the producer (manufacturer)
• Name and address of the appointed production enterprise (if needed)
• Name, series, specification and model of the certified products
• Normative references
• Certification mode (if needed)
• Date of issuance and validity
• Issuing organization
• Certificate number
• Other contents to be noted

22) The validity of a CCC certificate is 5 years.
The certification authority shall record the website and phone number to query the status of the annual supervision on the certificate based on the results of the monitoring of the certified products and enterprises.
In case that the certificate holder wishes to further use the certificate, he has to apply for an extension 90 days prior to expiration.

23) The certified products and the labeled content of the Certificates on the packaging shall be in conformity with the contents of the certificates and meet the requirements of the provisions adopted by the state on the product labeling.

24) In the following cases, the certification consignor shall apply for a certificate modification. The certification organization has to introduce proper treatment:
• Changes in the contents of the certificate (e.g., name and address of certification consigner, manufacturer or production enterprise etc.) can be approved by the certification organization after confirmation;
• Changes of model & specifications of the products that do not affect the safety performance or inner structure of electromagnetic compatibility can be approved by the certification organization after confirmation;
• Technical changes in certified product (design, structural parameters, critical components/raw materials, etc.), which would affect the conformity with related standards shall undergo a new product test by the certification organization;
• Factory’s changes in quality assurance system, production conditions, or relocation, etc., shall undergo a new factory inspection;
• Changes in other matters subject to the application for modification.

25) In case that the certification consignor wishes to extend the scope of the certificate, he has to submit the application for certificate extension. The certification organization has to verify the conformity between of the extended products and the certified products in order to check if the certificate is applicable to the extended products. A single certificate for the extended products or a new certificate for all the products can be issued after approval.
The certification organization reserves the right to conduct a discrepancy test on the extended products according to the certification requirements.

26) In the following cases, the certification authority shall cancel the certificate and announce the cancelation:
• The cancellation is mandatory, if the certification consignor has not applied for an application for renewal of the certificate before the expiry of validity;
• The cancellation is mandatory, if the production of certified products has been terminated;
• The cancellation is mandatory, if the models have already been included in the list of products that need to be eliminated in accordance with the formal government decisions or may no longer be produced;
• The cancellation is mandatory, if the certification authority has submitted an application for the cancellation of the certificate;
• In other cases prescribed by law.

27) In the following cases, the certification authority must suspend the certificate and publicize this:
• The suspension is mandatory, if changing duty exists due to renewal of the Implementing Rules and GB standards and no modification is made within the prescribed period;
• The suspension is mandatory, if the certification consignor has violated the certification regulations;
• The suspension is mandatory, if the supervision has been denied by the certificate holder or certification consignor without justification or if the product cannot continuously meet the certification requirements;
• The suspension is mandatory, if the certification consignor has submitted a request for suspending of the certificate;
• In other cases prescribed by law.

28) In the following cases, the certification authority shall withdraw the certificate and publicize this:
• The withdrawal is mandatory, if quality defects exist, which can lead to safety accidents;
• The withdrawal is mandatory, if the sample products are not in conformity with the certified products;
• The withdrawal is mandatory, if the certification consignor does not take corrective action during certificate suspension or the nonconformities cannot be closed by means of measures taken;
• The withdrawal is mandatory, if the certification consignor has obtained the certificate by cheating, bribery or other similar improper means;
• In other cases prescribed by law.

29) In the case of cancellation, suspension and withdrawal of the certificate, the certification organization shall determine the type and the scope of the nonconforming products.
The affected products are not allowed to leave the factory, sold, imported or used in other business activities from the date of cancellation, suspension and withdrawal of the certificate.

30) Patterns and lettering of CCC marking look like the following:

The label “CCC” stands for “China Compulsory Certification”.

31) The type of CCC certification, such as the small “s” (“Safety”) to 30) shall be marked to the right of the label.
The types of certifications are to be formulated and confirmed by the CNCA according to the certification demand.

32) The certification consignor shall establish a management system to manage the use of CCC mark and to monitor and archive the actual use of the mark. The CCC marks must be used and placed correctly on the packaging, in commercials, brochures and other promotional materials.

33) No company or any person may falsify the certificate and modify, deceive, sell, buy the CCC mark or transfer it to third parties.
