§2 Implementation of the Certification

7) The fundamental norms of the CCC Certification shall be formulated and promulgated by the AQSIQ and CNCA. The Implementation Rules of the CCC Certification (hereinafter referred to as “Implemention Rules”) shall be formulated and promulgated by the CNCA.

8) The CCC certification is to be enforced by one selected mode or a combination of the following:
• Technical appraisal
• Type-test
• Sample testing or verification on site
• Sample testing or verification on the market
• Inspection of the quality assurance capability of the company and inspection of the product conformity
• Supervision after the issuance of certificates
The selection of the certification mode has to be carried out based on the principle of convenience and with regard to the product characteristic, potential adverse effects on public security, human health and the environment, as well as risks of imported products, etc.

9) The Implementation Rules shall include, to the minimum, following points:
• Scope
• Normative references as GB Standards, industry standards and mandatory requirements of the technical regulations
• Certification mode
• Unit classification
• Requirements for the sampling test and test specimen
• Determination of the Key Components and Materials
• Requirements for the factory inspection
• Requirements for the supervision after the issuance of certificate
• Validity of the certificates
• Requirements for the CCC marking
• Other requirements

10) The manufacturer or distributor of the products, which have been included in the Catalogue of the Mandatory Products subject to the CCC, has to commission certification authorities nominated by the CNCA to certify the products manufactured, sold or imported products by him.
If the manufacturer commissioned by another company for the production of products subject to CCC, both the manufacturer and the customer can apply for CCC certification.

11) The certification consignor shall hand in application documents and relevant technical documents to the certification organization.
If the applicant is a distributor or an importer, he has to submit the contract between the dealer and the manufacturer and the contract between the importer and the manufacturer.
If other enterprises are commissioned to produce the products subject to CCC, the certification consignor shall submit the contract between the consignor and consignee.

12) The certification authority shall work out a plan for the type test and factory inspection after reviewing the application documents

13) The conformity of the test specimen to the actual manufactured products must be guaranteed by the certification consignor. Borrowed, rented or purchased pieces cannot be accepted. The samples shall be submitted by the principal to be reviewed for authenticity by the certification organization.
The type test is to be carried out by an accredited laboratory by the CNCA (hereinafter referred to as “lab”) on the test samples which are either transported by the certification consignor to the laboratory, or selected from the production or sealed by the certification organization.

14) Type test shall be accomplished at the CNCA-designated lab. For the type test of samples, the lab shall ensure that the test conclusion is true and accurate, and make complete records for the total testing process and put them into archive, thus assuring the traceability of the records for the testing process and results. In case of any abnormality during the type test, it shall communicate with the certification organization timely to work out corresponding measures.

15) In case that a factory inspection is necessary, the certification organization shall delegate nationally qualified to perform the inspection of the factory quality assurance ability, the conformity between the produced products and the test specimen handed in for the type test according to the product specific Implementation Rules.

The certification organization and its inspectors are liable for the inspection result.

16) In usual cases, the certificate shall be issued to the certification consigner within 90 days after the entrustment for certification is accepted if the result of the type test and factory inspection is deemed positive.

If the result cannot be deemed acceptable, the certification organization has to inform the consignor in written form of the reasons.

The certification organization and its personnel are liable for the certification result.

17) The certification organization shall, based on the by-category administration of production enterprises, exercise effective follow-up inspection over the certified products and their production enterprises, so as to demonstrate that the production enterprise’s COP control could keep complying with the certification requirements and assure that the certified products could keep satisfying the standard requirements and retain the consistency with the approved product.

18) The certification organization unfolds comprehensive evaluation to the conclusion of follow-up inspection, the conclusion of sampling testing or inspection, and related documents/information. If the result of any evaluation item is failed, the follow-up supervision result shall be evaluated as unsatisfactory; in this case, the certification organization shall decide to suspend or cancel the certificate based on the corresponding circumstance, which shall be made public.

19) A by-category administration of production enterprises is to be introduced by the certification organization with regard to the safety classes of products and stability of product quality, as well as positive and negative as positive entries. Here, the frequency of monitoring should be also determined by the certification organization.
